ARTICLE 1 – SCOPE

These general conditions of sale (hereinafter the "GTC") apply, without restriction or reservation, to all products offered for sale on the Site. The fact for a natural or legal person (hereinafter the "Customer") to order on the Site implies full and complete acceptance of the GCS. The T&Cs will remain in effect until a new version is put online. This is why, before any order validation, the Customer must consult and validate the GCS. Bike Shop reserves the right to adapt or modify the GCS at any time. In the event of modification, the GCS in force at the time of registration of the order will be applied to each order

ARTICLE 2 – CUSTOMER ACCOUNT

The opening of a Customer account and the use of the Site are free (excluding any connection costs, the price of which depends on the electronic communication operator), with no obligation to purchase. Only the purchase of products gives rise to payment by the Customer. Access to the Site by Customers is reserved for strictly personal use. When using the Site, the Customer declares to act in a private capacity. In addition to the acceptance of the GCS, the purchase on the Site is subject to the opening of a Customer account. The Customer must provide the data allowing his identification. ARTICLE 3 – INTELLECTUAL PROPERTY

The Site, its content and all the elements constituting it, are creations for which Bike Shop holds all the intellectual property rights and/or exploitation rights, in particular under copyright, database law, trademark law, and design law. The Site, as well as the software, databases, texts, information, analyses, images, photographs, graphics, logos, sounds, or any other data present on the Site, remain the exclusive property of Bike Shop or, where applicable, of their respective owners with whom Bike Shop has signed user agreements. The Customer has the right to consult the data and information present on the Site online, and may, for strictly private use, print or save them for a purchase or a purchase project. Any other use of the Site, in particular commercial, by the Customer, is prohibited. In particular, the Customer is prohibited from reproducing and/or representing for a use other than private use, selling, distributing, issuing, translating, adapting, disseminating and communicating in any form whatsoever, any element , information, or data from the Site. In addition, the Customer is prohibited from entering, by any means whatsoever, data likely to modify or affect the content or presentation of the Site. Any hypertext link to the Site must be expressly authorized in advance by Bike Shop. ARTICLE 4 – PRICES

For deliveries of Bike Shop products made on the metropolitan territory of the European Union, the prices indicated on the Site are expressed by default in Euros and all taxes included. For deliveries outside the metropolitan territory of the European Union, the prices are expressed by default in Euros and excluding any taxes. The Customer undertakes to pay, where applicable, all taxes that may be required of him by the Country of delivery, and in particular value added tax and any customs duties. These rights may be requested by the carrier. Bike Shop cannot be held responsible in the event that the Customer has not paid these taxes and duties. These rates break down as follows. Product prices: these prices can be modified at any time by Bike Shop. However, in case of modification, the sale price applied will be that in force at the time of registration of the order. The prices indicated on the Site do not include delivery costs, unless otherwise stated. Coupons : vouchers, discounts, promotional codes, loyalty checks issued by Bike Shop, cannot be combined and can be used for Bike Shop products. Shipping cost : delivery costs depend on the products and the delivery method chosen by the Customer from among the delivery methods offered by Bike Shop. These costs are indicated when the Customer selects the delivery methods, and can be consulted at any time in the “Deliveries” section of the Site. The amount (price of the products and delivery costs) indicated in the confirmation of the order by Bike Shop is the total price payable by the Customer

ARTICLE 5 – ORDERS

Any order validated by the Customer constitutes an irrevocable acceptance of the sales contract which can only be called into question within the limits provided for in the GCS. The two-step ordering procedure (by "double click"), associated with the authentication procedure and the protection of the integrity of the messages constitutes the validation of the sales contract. Bike Shop will acknowledge receipt of the order to the Customer by sending an order confirmation email. The Customer may consult the information relating to the order in the “my orders” section of the customer area. Bike Shop reserves the right to cancel any order from a Customer with whom there is a dispute. The information provided by the Customer when ordering commits the latter: in the event of an error in this information, and in particular the email address and contact details of the recipient, Bike Shop cannot be held responsible for the impossibility of delivering the product. Any delivery made to the address indicated by the Customer will be considered perfect. In the case of a reshipment due to a lack of information and/or error on the part of the Customer, the costs incurred by this reshipment will be invoiced to the Customer. In the event of the unavailability of a Bike Shop product, the Customer will be informed by email and the order for this specific product will be automatically cancelled. The rest of the order remains firm and definitive. If the payment for this product has already been debited from the Customer's account, it will be subject to a refund. Otherwise the price of the unavailable product will not be debited

ARTICLE 6 – PAYMENT OF THE PRICE

6.1 – Terms of payment

Payment is made online by the Customer when ordering. For all products, payment can be made:

  • by online bank card (Carte Bleue, VISA, Mastercard, American Express, Bancontact),
  • in installments, by the 3x 4x Sofinco reserve system (see article 14),
  • by PayPal,
  • either by credit card by telephone, by bank transfer,
  • by cheque,
  • by money order.

For each order, the payment will be collected separately for Bike Shop: at the order confirmation, the price of the Bike Shop products ordered and the Bike Shop delivery costs. The order validated by the Customer will only be considered effective when the payment has reached Bike Shop. In the event that Bike Shop's liability is sought for damages related to an error relating to the sums debited, Bike Shop may be exonerated from all or part of its liability by providing proof that the error is attributable either to the consumer, either to an unforeseeable and insurmountable fact of a third party, or to a case of force majeure. In accordance with article L. 441-6 of the commercial code, an indemnity of 40 € is due in the absence of payment the day after the date of payment appearing on the invoice as well as late payment penalties equivalent to 3 times the legal interest rate.

6.2 – Securing payments

Payments made on the Site are completely secure. The bank details (credit card number and expiry date) communicated by the Customer are never transmitted to third parties. Thanks to the technical characteristics of the encryption software used on the Site, the Customer's bank details cannot be intercepted by third parties. By communicating his bank details, the Customer accepts in advance and unconditionally that Bike Shop proceeds with the secure transaction. The Customer therefore authorizes his bank in advance to debit his account in view of the statements sent by Bike Shop, even in the absence of invoices signed by the hand of the cardholder. The authorization to debit the Customer's account is always given for the amount of the products purchased as invoiced by Bike Shop.

6.3 – Anti-fraud controls

Bike Shop checks certain orders, and may be required to ask the Customer for all the documents necessary to release his order

ARTICLE 7 – DELIVERY

Article 7.1: Delivery times and methods

After confirmation of the order, the Products ordered will be delivered by the carrier chosen by the Customer, subject to their availability, and unless otherwise indicated to the customer when placing the order, within a maximum period of twenty-four (24) hours worked. The Customer is informed by e-mail of each delivery of the products to the carrier. For Bike Shop products, the tracking of the current delivery is available on the Customer account. If the Customer specifically wishes several places of delivery, he must place several orders, the respective delivery costs for each of the orders being invoiced to him. For deliveries in mainland France, the carrier undertakes to deliver the order to the address provided by the Customer, within a period of between twenty-four (24) and seventy-two (72) working hours by Colissimo (Monday to Saturday), twenty-four (24) working hours by Chronopost (Monday to Saturday), seventy-two (72) to one hundred and twenty (120) working hours by Mondial Relay (Monday to Saturday) and from seventy-two (72) to one hundred and twenty (120) working hours by France Express (Monday to Saturday). All deliveries are made between eight (8) a.m. and six (6) p.m. to the address indicated by the Customer. In the event of absence, the Customer is normally notified by mailbox, by email or by SMS, depending on the carrier chosen. In the event of a delay in delivery beyond the period provided for when the contract was concluded, the Customer must contact Bike Shop Customer Service from his customer account, or by email, or by letter, in order to request that delivery is made within a reasonable additional time. If the delivery is still not made after this additional period, the Customer may request the cancellation of his order from Bike Shop Customer Service, from his customer account, or by email, or by letter. The order will be considered canceled upon receipt of this request. In this case, the Customer will be reimbursed for all sums paid within 14 days. Bike Shop is responsible for delivery and delivery times only for Bike Shop products.

Article 7.2: Reception

Upon delivery, the customer is required to sign the delivery note. This delivery note constitutes proof of receipt of the order. Delivery is made to the threshold of stores for street businesses or the ground floor for buildings, offices, homes (pavilions) or other establishments. It is up to the person ensuring the physical receipt of the order to mention on the delivery note, in a circumstantial, precise and detailed manner, all the reservations which seem relevant to him. In the event of apparent defects, the Customer has the right of return under the conditions set out below. In the event of an anomaly, the Customer must inform Bike Shop Customer Service as soon as possible by any means. The Customer retains his right to request the application of the legal guarantees.

Article 7.3: Returns and exchanges for non-compliance or defective products

The Customer benefits from the legal guarantees of conformity and hidden defects, in accordance with the legal provisions in force as referred to in the article Responsibilities – Guarantees. In the event that the Customer refuses delivery for an error in the content of the delivery, for non-compliance or defectiveness of the products ordered, he must immediately contact Bike Shop's Customer Service in the "Product Return" section on the Site, to determine the applicable return procedure and return address. The Customer is informed that the delivery points in “Point Relais” have the exclusive mission of allowing the collection of goods ordered by the Customer. Indeed, the "Point Relais" are not authorized to take the goods back without the express agreement of Bike Shop. Thus, the Customer can never go to a "Relay Point" in order to return his delivery, unless he has received the prior written agreement by email from Bike Shop according to the return procedure. indicated. In the event that the Customer does not respect the return procedure and goes to a "Relay Point" without prior agreement, the "Relay Point" would be entitled to refuse to accept the products. All items must be returned with their accessories and manuals, and, as far as possible, in their original packaging. The Customer has the legal time limit to request a credit note or have the price refunded, in whole or in part, in accordance with the provisions of Article L.217-10 of the Consumer Code. The consumer benefits from a period of 2 years from the delivery of the goods to act. The consumer can choose between the repair and the replacement of the good. As specified in Article L217-9 of the Consumer Code, the seller may however choose another method than that chosen by the buyer if this choice entails a manifestly disproportionate cost with regard to the other method. The consumer is exempted from providing proof of the existence of the lack of conformity of the goods during the 6 months following the delivery of the goods. As of March 18, 2016, this period will be extended to 24 months. The legal guarantee of conformity applies independently of the commercial guarantee that may be taken out. The consumer can decide to implement the guarantee against hidden defects of the thing sold. In this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code

ARTICLE 8 – TRANSFER OF OWNERSHIP – TRANSFER OF RISKS

The transfer of ownership of the products, for the benefit of the Customer, will only be carried out at the time of delivery of the said products

ARTICLE 9 – RIGHT OF WITHDRAWAL

9.1 In accordance with article L.221-18 of the Consumer Code, the Customer has a period of fourteen days from the date of receipt of the order to exercise his right of withdrawal, without having to justify his decision or other costs than those provided for in Articles L. 221-23 to L. 221-25. 9.2 The exercise of the right of withdrawal must be made with Bike Shop. To ensure proper handling of their request, the Customer is advised to keep Bike Shop informed in due time and to follow the return procedure detailed in the “Product Return” section of the Site. 9.3 The product must be returned by post, preferably with delivery against signature, to the address indicated in the withdrawal form attached to the GCS for Bike Shop products. He must send them to this address within fourteen (14) days of sending his withdrawal. Return costs will be the sole responsibility of the Customer. Bike Shop is not responsible for lost returns. 9.4 The product must arrive in perfect condition for resale, without trace of use, with its accessories, instructions and original packaging. The conformity of this return will be checked and validated upon receipt. 9.5 Bike Shop will refund the sums paid by the Customer, free of charge, with the exception of return costs. In the event of the return of all Bike Shop products, the amount of the refund will include the price of the products concerned and the delivery costs (one way) of Bike Shop. In the event of a partial return of an order, the amount of the refund will only include the price of the products concerned, without the delivery costs (one way). Reimbursement is due within a maximum period of fourteen (14) days. However, reimbursement may be deferred until recovery of the goods by the Bike Shop concerned, or receipt of proof of shipment of the return of the product. 9.6 In the event of exercise by the Customer of his right of withdrawal, when the price of the order, subject of the withdrawal, is fully or partially covered by a credit granted to the Customer, the credit agreement is terminated, without penalty

ARTICLE 10 – LIABILITY – GUARANTEE

10.1 Bike Shop assumes with regard to the Customer the responsibility relating to the products which it sells, in accordance with the regulations in force. 10.2 Bike Shop cannot be held liable for minor variations which may have remained despite all the precautions taken in the representation of the products. 10.3 In the event of non-compliance, the Customer may choose between the repair and the replacement of the product. As specified in Article L217-9 of the Consumer Code, the seller may however choose another method than that chosen by the buyer if this choice entails a manifestly disproportionate cost with regard to the other method. If the repair and the replacement of the product are impossible, the Customer can return the good and have the price returned, or keep the product and have part of the price returned in accordance with article L.217-10 of the Code of the consumption. The legal guarantee of conformity applies independently of any commercial guarantee from the seller or the manufacturer. The consumer benefits from a period of 2 years from the delivery of the goods to act in the event of non-compliance. 10.4 In the event of hidden defects, the seller is bound by the guarantee for defects which render the product unsuitable for the use for which it is intended, or which reduce this use so much that the Customer would not have acquired it, or I would have paid a lesser price for them, if he had known them. In this case, the Customer has the choice to return the product and have the price refunded, or to keep the product and have part of the price refunded. The Customer benefits from a period of 2 years from the discovery of the defect. 10.5 Bike Shop cannot be held responsible for non-compliance with the regulations and laws in force in a receiving country other than France. The Customer is solely responsible for the choice of products, their conservation and their use. 10.6 Unless the producer is not identifiable, Bike Shop cannot be held liable for damage of any kind, whether material, immaterial or bodily, which could result from a malfunction or misuse of the products marketed. The same applies to any modifications to the products resulting from the manufacturers. 10.7 In addition to the legal guarantee of conformity and the legal guarantee against hidden defects, certain products benefit from an additional commercial guarantee offered by the manufacturer. The conditions of these commercial guarantees are accessible from the Site and the sheet of the product concerned. This commercial warranty does not generally cover the equipment used in the context of competition or rental, damage related to wear, misuse, lack or lack of maintenance, or any modification made to the product after delivery. This commercial warranty also does not cover:

  • the replacement of so-called consumable products,

Within the framework of this specific commercial guarantee, all returns of defective parts generally remain the responsibility of the Customer. Any incomplete or partial return cannot be taken as a guarantee. Any traces of modifications or dismantling will void the warranty. 10.8 For any question on the guarantees relating to the products, the Customer has the possibility, before placing an order, to ask a question to Customer Service, via the contact section of the Site

ARTICLE 11 – CONFIDENTIALITY – PROTECTION OF PERSONAL DATA

These T&Cs are subject to the provisions of European Regulation 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, as well as those of Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms and any other regulations applicable in the matter which would supplement or replace them later. Depending on the choices made when creating or consulting their account, the Customer will therefore be likely to receive offers from Bike Shop. The Customer has the option of unsubscribing from Bike Shop newsletters at any time either by clicking on the link present in all e-mails or by going to this address https://www.revedevelo.com/newsletter/desinscription. The Customer also has the possibility of registering on the list of opposition to cold calling. Information relating to this system is available on the site http://www.bloctel.gouv.fr/. The Customer can also consult and modify his personal data in his customer area.
